If a business has failed to carry out any risk assessment to what a potential disaster could be they will have little to no defence when it comes to responding to the regulator.

It is a misconception to think a pollution incident doesn’t get reflected in the cost to the business. The public normally only see the fine, this does not include the clean up costs and legal expenses a business has also had to pay; more importantly the damage to the corporate brand.

In 2009 the UK signed up to the European environmental damage regulations which forces a “Polluter pays” mentality. If you pollute you have committed a crime and must pay to repair any damage to the environment.

In 2010 civil sanctions were launched in the UK allowing the Environment Agency to issue on the spot fines for businesses operating with unsafe environmental controls

In 2014 New UK Environmental sentencing guidelines where launched. These have increased fines significantly with high profile cases in 2017, Tesco fined £8milion for one oil spill and Thames Water fined £20 million for a sewage spill. The new guidance focuses on the size of a whole organisation and its ability to make investment in good pollution practise.

In todays corporate world many customers require ISO9001 and 14001 and evidence that a business has not been fined for a pollution incident. Pollution is a criminal act and a business will need to respond quickly and sensitively to an incident. Failure to show clear understanding and evidence of pollution control will leave a business unable to defend its position in court leading to large fines and even prison sentences if negligence can be proven.
